How is single-family home ownership different from Condo ownership?

Simple answer: rules, laws and standards.

 

These laws, rules and standards affect the community members’ everyday life and can feel constraining.

 

And while all unit owners are members of the condominium association, no one owner may act for or on behalf of the association simply by being a member. That’s why Condominium Association Boards, elected by the unit owners, exist.

Who is the Board of Directors?

Board volunteers are your neighbors, but in their board role, they also have a legal and fiduciary duty to act for the good of the association, rather than for the benefit of themselves. They must exercise reasonable care in all decision-making, without placing the organization under unnecessary risk.

What is a CAM?

Condo Association Management companies are known as CAMs. Some tasks can, and generally are, delegated to Condo Association Management companies – CAM.

 

That said, every Board of Director owes a duty of care and loyalty to the association. Those duties exist regardless of whether a task has been delegated to the CAM.

What are the rights and obligations of the Board?

The Board of Directors are obligated to uphold and enforce all the covenants and restrictions – no matter how rigid or legalistic they may seem – until they are formally changed. And these covenants and restrictions cannot be changed willy-nilly either. They must be consistent with Fiddler’s Bend own governing documents.

What are the Governing Documents?

Collectively the Articles of Incorporation, Declaration, Bylaws and Rules are called the governing documents. They consist of:

 

  • The Articles of Incorporation is the original document creating the Association. Fiddler’s Bend Certificate of Incorporation was granted on December 21st, 1973.

  • The Declaration is the document or set of documents that creates the condominium. Fiddler’s Bend Villas were created via Declaration November 6, 1974, with the Bylaws attached as Exhibit E.

  • The Bylaws which govern the operation of the association. As may be desired, Bylaws may also contain provisions that are not inconsistent with the Florida Condominium Act or with the declaration.
